Terms of Service

1. Who we are & agreeing to these terms
RosieChecks (“Rosie,” “we,” “us,” or “our”) is a scam-checking service operated by ClickThere Marketing, LLC. These Terms of Service (the “Terms”) are a legal agreement between you and ClickThere Marketing, LLC. They cover your use of the RosieChecks website at rosiechecks.com, the Rosie forwarding addresses and phone numbers, your account dashboard, and any related features (together, the “Service”).
By creating an account, adding a person to protect, forwarding a message to Rosie, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service.
2. What Rosie does
Rosie helps people spot scams. Typically an adult child (the “account owner”) sets up Rosie for a parent or other loved one (a “protected person”). The protected person forwards a suspicious text message or email — or a screenshot of one — to a private Rosie address or phone number. Rosie reviews it using automated analysis and replies in plain language with whether the message looks safe, suspicious, or like a scam, along with a suggested next step. When something looks risky, Rosie can also alert the account owner.
Rosie is an informational tool. She does not block messages, take action on your accounts, contact senders, recover money, or provide professional, legal, financial, or security advice. The decision about what to do with any message is always yours.
3. Who can use Rosie
You must be at least 18 years old and able to enter into a binding contract to be an account owner. The Service is intended for personal, non-commercial use to protect yourself or people you care about. When you set Rosie up for someone else, you confirm that you have their permission to enroll them, to receive Rosie’s alerts about their messages, and to provide their information (including any phone number) to us.
4. Your account
- You’re responsible for the information you give us and for keeping it accurate.
- We sign you in with an email “magic link” instead of a password. Keep access to your email secure — anyone who can open your sign-in link can reach your dashboard.
- You’re responsible for activity that happens under your account, and for the people you add as protected persons.
5. Text messages & phone numbers
Rosie can work over SMS/text message. By providing a mobile phone number — your own, or a protected person’s — you represent that the number is correct and that you are the subscriber or have the subscriber’s permission to use it with Rosie. You consent, on behalf of that phone’s user, to receive recurring automated text messages from Rosie related to the Service, including Rosie’s replies to forwarded messages and scam alerts.
- Message frequency varies — it depends on how often messages are forwarded to Rosie.
- Message and data rates may apply. Your mobile carrier’s standard charges are your responsibility, not ours.
- Opt out any time. Reply STOP to a Rosie text to stop receiving messages on that number; reply HELP for assistance. You can also remove a phone number in your dashboard or by contacting us.
- Carriers aren’t liable for delayed or undelivered messages, and we can’t guarantee that every text will be delivered or arrive on time.
- Consenting to texts is not required to buy anything from us — it’s simply how this part of the Service works.
You agree not to use Rosie’s phone numbers or addresses to send unlawful, harassing, or bulk/automated traffic, and not to enroll a phone number you’re not authorized to use.
6. Using Rosie responsibly
When you use the Service, you agree not to:
- Forward someone else’s private messages without a lawful reason or their permission;
- Use Rosie for anything illegal, or to harm, harass, or deceive others;
- Try to break, overload, reverse-engineer, scrape, or gain unauthorized access to the Service or its underlying systems;
- Resell or commercially redistribute Rosie’s assessments; or
- Misrepresent who you are or your authority to enroll a protected person.
7. Rosie can be wrong — no guarantee of results
The Service relies on automated analysis (including third-party AI models) that is probabilistic by nature. We do not promise, and you should not assume, that Rosie will:
- correctly classify every message;
- catch every scam, fraud, phishing attempt, or malicious link; or
- be free of “false alarms” (safe messages flagged as suspicious) or “misses” (scams marked safe).
Rosie’s assessments are for general informational purposes only and are not professional, legal, financial, cybersecurity, or investment advice. You and any protected person remain solely responsible for deciding what to do with any message. When something matters, verify it independently — for example, by contacting the company or person directly using a phone number or website you already trust, and never send money, payment codes, passwords, or personal information based on a message alone.
To the fullest extent permitted by law, we are not responsible or liable for any loss, damage, or harm arising from Rosie’s results or from any action you take or don’t take in reliance on them — including a message Rosie marked safe that was actually a scam, or a legitimate message Rosie flagged. Your use of Rosie’s assessments is at your own risk.
8. Trials, billing & cancellation
Rosie is a paid subscription. Pricing, billing frequency (such as monthly or yearly), and any free-trial length are shown to you at sign-up and checkout, and those displayed terms apply to your purchase.
- Payments. Payments are processed by Stripe. We don’t see or store your full card number; Stripe handles your card details under its own terms and security standards.
- Trials & activation. If a trial is offered, starting it may require a payment method and a small one-time activation charge, shown at checkout. Unless you cancel before the trial ends, your subscription will begin and the payment method on file will be charged.
- Renewals. Subscriptions renew automatically at the end of each billing period until you cancel.
- Cancelling. You can cancel anytime from your dashboard settings or by contacting us. Cancellation stops future charges; access generally continues until the end of the period you’ve already paid for.
- Refunds. Except where required by law, payments are non-refundable. If you think you were charged in error, contact us and we’ll look into it.
- Without an active subscription, the Service is limited — for example, Rosie may acknowledge a forwarded message but withhold the full assessment, and account alerts may be paused.
9. Services we rely on
To run Rosie we use trusted third-party providers — including an AI provider to analyze messages, a payment processor (Stripe), and hosting and email-delivery providers. Using Rosie means message content and related data are processed by these providers as described in our Privacy Policy. We are not responsible for the independent acts or services of third parties, and their own terms may also apply.
10. Our content
The Service — including the RosieChecks name and logo, the website, Rosie’s wording, and the software behind it — is owned by us or our licensors and protected by intellectual property laws. We grant you a personal, limited, non-exclusive, non-transferable right to use the Service for its intended purpose. You keep ownership of the messages you forward; you grant us permission to process them only to provide and improve the Service as described in the Privacy Policy.
11. Disclaimer of warranties
The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, timely, secure, error-free, or that any assessment will be accurate or complete.
12. Limitation of liability
To the fullest extent permitted by law, ClickThere Marketing, LLC and its owners, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of money, data, goodwill, or other intangible losses, arising out of or related to your use of (or inability to use) the Service — including any losses caused by a scam Rosie failed to catch or a message Rosie misclassified.
To the fullest extent permitted by law, our total liability for all claims relating to the Service will not exceed the greater of (a) the amount you paid us for the Service in the 12 months before the event giving rise to the claim, or (b) US $100. Some jurisdictions don’t allow certain limitations, so some of these may not apply to you; in that case our liability is limited to the smallest amount the law allows.
13. Your responsibility to us
You agree to defend, indemnify, and hold harmless ClickThere Marketing, LLC from claims, damages, and reasonable costs (including attorneys’ fees) arising out of your misuse of the Service, your violation of these Terms or any law, or your enrolling a person or phone number without the proper permission.
14. Changes to the service or these terms
We may update, add, or remove features, and we may revise these Terms from time to time. If we make material changes, we’ll update the “last updated” date above and, where appropriate, give notice. Continuing to use the Service after changes take effect means you accept the updated Terms.
15. Ending your use of Rosie
You can stop using Rosie and close your account at any time. We may suspend or end your access if you violate these Terms, misuse the Service, or where we’re required to by law. Sections that by their nature should survive — such as the accuracy disclaimer, warranty disclaimer, limitation of liability, and indemnification — continue to apply after your use ends.
16. Governing law & disputes
These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-laws rules. You and we agree that the state and federal courts located in Travis County, Texas will have exclusive jurisdiction over any dispute that isn’t resolved informally, and you consent to venue there.
